Terms of Service

1. Agreement & service provider

These Terms of Service govern your use of Buildback, its website, dashboard, APIs, and embedded feedback and changelog widget (the “Service”). Buildback is operated by Aditya Kumar in India under explorme.com. In these terms, “we,” “us,” and “our” refer to the operator, and “you” refers to the person or organization using the Service.

By creating an account or using the Service, you agree to these terms. If you do not agree, do not use the Service. You must be at least 18 years old and able to enter a binding agreement to create an account. If you act for an organization, you confirm that you have authority to bind it.

2. Accounts & your responsibilities

Provide accurate account information, keep your credentials secure, and tell us promptly about suspected unauthorized access. You are responsible for activity under your account and for the projects and integrations you manage.

When you embed Buildback, you are responsible for your website, the information you ask visitors to submit, and any notices or permissions required by applicable law. Do not ask visitors to submit passwords, payment details, or sensitive personal information through feedback forms.

3. Acceptable use

Use Buildback lawfully and respectfully. You must not:

• Post spam, unsolicited promotions, illegal content, threats, harassment, or content that infringes someone else’s rights on feedback boards or changelogs.
• Upload malicious code, distribute malware, or attempt unauthorized access to accounts, systems, or another organization’s data.
• Manipulate votes, impersonate others, or mislead users about who submitted content.
• Overload the Service, circumvent rate limits or security controls, or interfere with other users’ access.
• Collect or disclose personal information without appropriate permission or a lawful basis.

We may remove unlawful or abusive content and restrict access to protect the Service and its users. Report abuse to support@explorme.com.

4. Your content & intellectual property

You retain ownership of content you submit, including feedback, project information, and release updates. You grant us a non-exclusive permission to store, process, reproduce, and display that content only as needed to operate the Service and fulfill your instructions. You confirm that you have the rights needed to submit it.

Buildback’s name, branding, designs, and proprietary software belong to Aditya Kumar or their respective owners. These terms grant you permission to use the Service, not ownership of its intellectual property. Third-party and open-source components remain subject to their own licenses.

5. Privacy & third-party services

Our Privacy Policy explains how we handle personal information. Buildback relies on infrastructure providers, including Supabase for database and authentication services. External websites and services linked from Buildback have their own terms and policies.

6. Availability & changes

We may improve, modify, or discontinue features, and access may be affected by maintenance or events outside our control. We aim to communicate material changes where reasonably practicable, but do not promise uninterrupted access or a specific service level unless separately agreed in writing.

7. Account termination

You may stop using Buildback at any time and request account closure at support@explorme.com. We may suspend or terminate access for violations of these terms, unlawful activity, security risks, or a legal requirement. Where appropriate and reasonably practicable, we will explain the reason and give you an opportunity to address it; urgent risks may require immediate action.

After termination, your right to access the Service ends. Information is handled in accordance with our Privacy Policy and applicable law. Provisions that should reasonably survive termination, including intellectual property, liability limitations, and governing law, continue to apply.

8. Disclaimer of warranties

To the fullest extent permitted by applicable law, the Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or meet every requirement. See our Disclaimer for more information.

9. Limitation of liability

To the fullest extent permitted by applicable law, Aditya Kumar and Buildback will not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, revenue, goodwill, business opportunities, or data arising from your use of, or inability to use, the Service.

To the same extent, our total aggregate liability for claims arising from the Service will not exceed the amount you paid us for the Service in the 12 months preceding the event giving rise to the claim. These limitations apply regardless of the legal basis of the claim. Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, or overrides mandatory statutory or consumer rights.

10. Governing law & disputes

These terms are governed by the laws of India. Subject to any mandatory rights or jurisdiction required by applicable law, disputes are subject to the jurisdiction of the competent courts in India. Please contact us first so we can try to resolve your concern directly.

11. Updates & contact

We may update these terms and will publish the revised version here with an updated date. For material changes, we will provide notice through the Service or by email where reasonably practicable. Continued use after revised terms take effect indicates your acceptance, subject to applicable law. If you do not accept the changes, stop using the Service.
